The In's & Out's of HUD Homes

What is a HUD home?  Many of us have heard of them but don’t really know what they are.  A HUD home is a home that home that has been foreclosed and had been FHA (Federal Housing Administration) Insured prior to foreclosure.  In other words, the former owner had a FHA loan as their mortgage and lost the home to foreclosure.   Because the mortgage was FHA insured prior to foreclosure, the government agency HUD (Housing and Urban Development) takes ownership after the foreclosure.

Now that we know what a HUD home is, we can discuss the oddities that are involved with purchasing one.  Buying a HUD home is substantially different than buying a home that is owned by a bank.  In a typical transaction involving a foreclosed property, the buyer signs a written offer/contract and their agent delivers it to the listing agent who then submits it to the owner (bank).  In a HUD home transaction, the buyer’s agent deals directly with the asset manager assigned by HUD.  All offers are submitted electronically via the HUD home website and the buyer’s agent is notified via email if their buyer’s offer is accepted.

Once an offer is accepted, the buyer and their agent have only 48 hours to complete and deliver the original copy of the HUD contract to the designated HUD agent.  The contract package is generally available on the HUD website once the buyer’s offer is accepted.  The HUD contract looks different than the regular purchase contracts that agents are used to using...

Once you have chosen a home, the fun begins!  Set up a time to meet with your realtor to complete the necessary paperwork for making an offer to the seller of the home you have chosen.  Call your lender and let them know that you will be making an offer.  Your lender will provide you and/or your realtor with a document called a pre-qualification or pre-approval letter stating that you are able to obtain financing for the purchase. 

Meet with your realtor and determine what price to offer for the home you have chosen.  Your realtor will provide and explain all of the necessary paperwork to make the offer and will answer any questions you may have about it.  You will need to decide on an amount of money called Earnest Money that you will be putting up as a deposit with your offer.  Earnest Money acts as a good faith deposit and helps the seller know that you are a serious buyer.  There is no required amount of earnest money to put down but you are required to put something down.  When your purchase closes, the amount of earnest money you put down is credited toward the purchase.  If for some reason you have to cancel the contract, you can get your earnest money back as long as you have complied with the deadlines in your purchase contract (which we will cover in a later segment).  Once the paperwork is complete and you have provided your realtor with a check or other funds for earnest money, your realtor will submit your offer to the realtor that has the...

Ok, so you’ve chosen a lender and realtor, now the hard part: choosing a home.  To make the most efficient use of yours and your realtor’s time, it is wise to review the list of potential homes and narrow it down to 10 or less before you go out shopping.  This way you can spend your time looking at the homes that most closely meet your needs without wasting time on ones that don’t.  Let your realtor know in advance (a day is okay, 2-4 days is even better) when you are available to look at homes so they can arrange their schedule to meet with you and also set up the showing appointments on the homes you want to view.  Sometimes, it’s difficult to give much notice so we suggest staying in regular contact with your realtor via phone, text, and email so that you are all on the same page.  By letting your realtor know up front what kind of schedule you have and generally what times/days you are available, you will allow them to arrange their own schedule so that they can provide you with top quality service.

When viewing homes, there are a few “rules” or at the very least guidelines that you should try to follow.

  • First, if you are married or are buying a property with a partner/friend/associate, be sure that all of you are present.  While this isn’t always possible, it makes the decision process much easier.

It's that time of year again...Leaves are falling, temperatures are cooling, and winter is just about here!  Here are some common winter problems and tips to prepare your home.

Ice Dams
An ice dam is an accumulation of ice at the lower edge of a sloped roof, usually at the gutter. When interior heat melts the snow on the roof, the water will run down and refreeze at the roof’s edge, where temperatures are much cooler. The ice builds up and blocks water from draining off of the roof, forcing the water under the roof covering and into the attic or down the inside walls of the house. Take the following steps to decrease the likelihood that ice dams will form:

• Keep the attic well-ventilated. The colder the attic, the less melting and refreezing on the roof.
• Keep the attic floor well-insulated to minimize the amount of heat rising through the attic from within the house.
• As an extra precaution against roof leaks in case ice dams do form, when re-roofing install an ice and water barrier under your roof covering that extends from the lowest edges of all roof surfaces to a point at least 24 inches inside the exterior wall line of the building.

Frozen  Pipes
Frozen water in pipes can cause water pressure buildup between the ice blockage and the closed faucet at the end of a pipe, which leads to pipes bursting at their weakest point. Pipes in attics, crawl spaces and outside walls are particularly vulnerable to freezing in extremely cold weather....

Having Fun & Giving Back!

We want to personally thank everyone at Remax that came out and volunteered at the "Big Barn Party" last Saturday!  We helped with Horse Painting and it was so much fun to see the kids interact with the animals and their excitement as they touched and felt for the first time a horse, goat, rabbit, pig, turkey, frog, etc... The party raised over $1500 for Big Brothers and Big Sisters.  It costs $800 per match and there is a waiting list of over 40 kids to pair.  Thanks again, You guys Rock!

What do I do if I need to sell my house but I owe more than it's worth?

There is no clear cut answer to this question.  The truth is, each situation is different and it's up to the homeowner to decide which solution best fits their needs.  Many homeowners don't realize that they have options when faced with owing more on their home than what they can sell it for.  Some have the funds available to make up the difference at closing while others may be faced with job loss or other circumstances that are out of their control.  When faced with those circumstances, options for the homeowner include: short sale (selling a property for less than what is owed on it), bankruptcy, and loan modification.  Each of these options can help in avoiding foreclosure.  We have assisted many clients with short sales  in St. George, UT and the surrounding areas but that isn't always the best option. 

When we first meet with a client facing possible foreclosure, we learn more about their situation and help them determine whether or not short sale is a good option for them.  We advise that they meet with an attorney (many will give free consultations) and also with a tax expert to determine what, if any, penalties may be incurred if a short sale is completed.  Then we discuss their situation or "hardship" so that we can better assist them if they decide to do a short sale.

How's the market?

Everyday we get calls from buyers, sellers, current homeowners, and investors all asking the same question about real estate in Southern Utah...'How's the market?'  That's a loaded question because you could ask 10 different agents that same question and get 10 different answers.  The reality of it is that the market is improving and homes are selling!  Inventory below $300,000 is shrinking and there are many buyers out there ready to scoop up a good deal.  The key here is "good deal"...pricing is very competitive and is the first thing buyers are looking at when deciding on homes to consider.  We still have a lot of foreclosed and short sale homes on the market that are keeping prices down but we have noticed that there are fewer foreclosed homes coming on the market.  For seller's, pricing is the key to getting sold quickly.  Length of time on the market has decreased as well over the last few months and accurate pricing is the reason for this.
